Terms of Service

Effective date: 22 May 2026

1. Acceptance

By downloading, installing, or using the Triphaus application (“App”) or visiting the Triphaus website at triphaus.app (“Site”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App or Site.

These Terms form a contract between you and the operator of Triphaus:

2. Description of the service

Triphaus is a travel organisation app for iOS that lets you import booking confirmations (via AI extraction), manage itineraries, and plan trips. The service is offered in a free tier (limited AI quota) and a paid tier (higher AI quota, billed through the Apple App Store).

Features are subject to change. We will notify you of material changes in-app.

3. Account creation and Sign in with Apple

You must create an account using Sign in with Apple to access Triphaus. You are responsible for maintaining the confidentiality of your Apple ID. You must be at least 16 years old to use the App.

You may not share your account or use the App on behalf of another person without their consent. You are responsible for all activity under your account.

4. Subscriptions, payments, and cancellation

4.1 Free tier

The free tier provides a limited number of AI-assisted trip imports per calendar year (currently 10). This limit may change; changes will be communicated in-app at least 30 days before taking effect.

4.2 Paid subscription

The Triphaus Pro subscription is offered on an annual or monthly basis, purchased through the Apple App Store. Pricing is shown in the App at the time of purchase and may vary by App Store region.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.

4.3 Cancellation

Cancel at any time in: iOS Settings → [your Apple ID] → Subscriptions → Triphaus. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period, except where required by applicable law.

4.4 Refunds

All purchase and refund queries are handled by Apple Inc. under its App Store policies. Triphaus has no access to payment information and cannot issue refunds directly.

4.5 Price changes

We will notify you of price changes at least 30 days in advance via in-app notification. Continued use after the effective date of a price change constitutes acceptance.

5. Acceptable use

You agree not to:

  • Use the App or Site for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or disassemble the App.
  • Interfere with or disrupt the servers or networks connected to the App.
  • Scrape, crawl, or harvest content from the App or Site by automated means.
  • Introduce malware, viruses, or any malicious code.
  • Circumvent usage quota or access controls.
  • Use the App to infringe third-party intellectual property rights.

We reserve the right to suspend or terminate your account if you violate these rules.

6. Content ownership and licence

6.1 Your content

You retain ownership of the travel data, documents, and other content you submit to the App (“Your Content”). By using the App, you grant us a limited, non-exclusive licence to process Your Content solely to provide the service to you (including transmitting documents to OpenAI for AI extraction). This licence ends when you delete your account.

6.2 Our content

The App, Site, branding, design, and code are owned by or licensed to the operator of Triphaus. You may not reproduce, distribute, or create derivative works without prior written permission.

7. Third-party services

Triphaus uses OpenAI’s API to power the AI import feature. Your use of that feature is subject to OpenAI’s Terms of Use in addition to these Terms. Triphaus is not responsible for OpenAI’s services or any output generated by them. AI-extracted data may contain errors; always verify itinerary details before relying on them.

Triphaus is not affiliated with, endorsed by, or sponsored by any airline, hotel chain, or other travel provider.

8. Disclaimer of warranties

THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. AI-extracted itinerary data is provided for convenience only — you bear sole responsibility for verifying travel arrangements.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR OF TRIPHAUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP OR SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for any claim arising from these Terms or the App shall not exceed the amounts you paid to us (via Apple) in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under German law.

10. Governing law and dispute resolution

These Terms are governed by German law, excluding its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

If you are a consumer resident in the EU, you also benefit from the mandatory consumer-protection provisions of the law of your country of residence.

The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obliged to participate in any alternative dispute resolution procedure before a consumer arbitration board, but we are willing to try.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app at least 30 days before taking effect. Continued use of the App after that date constitutes acceptance of the revised Terms. If you do not agree, stop using the App and cancel your subscription.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms, with or without notice. You may stop using the App at any time. Sections 6.2, 7, 8, 9, and 10 survive termination.
